“Blue Skies:  No Limits”
Official Rules


    1.    Dates/Eligibility.  The KSL 5 TV, Maverik and Salt Lake Community College “Blue Skies: No Limits” (the “Contest”) begins May 22, 2009 and ends July 4, 2009.  KSL 5 TV (the “Station”) may change the dates and/or terms of the Contest without prior notice.  Any material changes will be posted on a page at www.ksl.com (the “Site”).  The Contest is open to all legal residents of Utah, eighteen (18) years of age and older at the time of entry.  There is no purchase necessary to enter or win.  A purchase will not increase a contestant’s chance of winning.  The Contest is void where prohibited by law.  Employees or agents of the Station, Bonneville International Corporation, Maverik Country Stores, Salt Lake Community College, Upper Limit Aviation, Cornerstone Aviation, any entity associated with the sponsorship or administration of the Contest (collectively, the “Sponsors”) or any other television or radio station that serves the Salt Lake City, Utah area, as well as members of the same household of any such employee or agent, are ineligible to participate.

    2.    How to Enter.  Beginning May 22, 2009 and continuing until approximately 11:59 p.m., July 4, 2009, contestants can enter the Contest by telling us in 55 words or less, “Why you want to kick start your life and fly”. Contestants may submit their essay responses by completing the “Blue Skies: No Limits” entry form available on the Site. Alternatively, contestants may submit an essay response by mail.  Any mailed-in response must include, in addition to the essay response, the contestant’s name, address, age, telephone number and the name of the Contest and must be sent to KSL 5 TV, Broadcast House, 55 North 300 West, P. O. Box 1160, Salt Lake City, Utah 84110-1160.  In order to be valid, mailed-in entries must be received by the Station on or before June 26, 2009.  Limit one (1) entry per person, regardless of entry method.  All entries become the sole and exclusive property of the Station.

    3.    Selection of Winners.  On or around July 6, 2009, based on the essays submitted by Contestants, the Station will select ten (10) finalists from all eligible entries received by the deadlines indicated above.  The Station will attempt to contact each finalist using the information contained on the entry form or postcard.  If the Station is unable to contact a finalist in a timely manner, the Station may discard the finalist’s entry form or postcard and select an alternate finalist.  This process will continue until ten (10) finalists are selected and notified.  The ten (10) finalists will complete a casting application to determine their eligibility to appear on Maverik’s Kick Start television program and will be interviewed by representatives from Salt Lake Community College and Maverik’s KickStart program at a predetermined time between July 6, 2009 and July 10, 2009.  Based on contestant’s responses in the essay, the casting application, and the interview, representatives will select two (2) winners by July 10, 2009 to receive a Grand Prize.

    4.    Prizes.  Two (2) Grand Prizes will be awarded in the Contest.  One Grand Prize  will consist of approximately fifty (50) hours of helicopter flight training at Upper Limit Aviation, 619 North 2360 West, Salt Lake City, Utah 84116, weather permitting.  The approximate retail value of this prize is $18,000.  One Grand Prize will consist of approximately twenty five (25) hours of fixed wing flight training at Cornerstone Aviation, 337 North 2370 West #130 Salt Lake City, Utah 84116.  The approximate retail value of this prize is $10,000.  The dates and times will be determined by Upper Limit Aviation and/or Cornerstone Aviation but must be completed by August 14, 2009.  The representatives from Salt Lake Community College and Maverik’s KickStart program will determine what prize each Grand Prize winner receives.  In order to receive the prize, winners must agree and be eligible to be featured on a segment of Maverik’s KickStart on KSL 5 Television, August 15, 2009 and/or August 22, 2009.  Prizes are not transferable, subject to substitution by the contestant or redeemable for cash.  Should the original prize become unavailable for any reason, the Station and/or the Sponsors reserve the right to substitute an equivalent prize or prize of comparable value.  Winners will be required to complete an IRS Form W-9 and will receive an IRS Form 1099-Misc.

    5.    Conditions/Restrictions. 

Physical Restrictions: Each winner will have to meet certain physical requirements designated by Upper Limit Aviation and Cornerstone Aviation as a condition of receiving their prize.  The maximum weight limit for the winner cannot exceed a total of two hundred (200) pounds.  Winners will be weighed for verification at Upper Limit Aviation or Cornerstone Aviation prior to the helicopter or airplane departure. 

Background Check: Winners must have a valid driver’s license, no DUIs on record, no drug convictions on record, no felonies on record, no more than three (3) speeding tickets in a 3-year period.  Winners must agree to allow the Sponsors to access such records, databases or information as is necessary to verify the foregoing information in order to determine that winners have met these requirements.

Maverik’s KickStart Program: Winner must agree to be featured on a segment of Maverik’s KickStart program on KSL television on August 15, 2009 and/or August 22, 2009, and must agree to be available for filming at the designated place and time.  Winners must meet the eligibility requirements to appear on Maverik’s KickStart as outlined in the casting application that each finalist will complete as part of the final interview process. Winners must provide complete and accurate information on the casting application in all matters, including their eligibility to appear on the show, their willingness to submit to required background checks and medical examinations, and their willingness to execute appropriate waivers and release agreements in connection with appearing on the show. 

General Release: As a condition of receiving their prize, prize winners will be required to produce identification satisfactory to the Station and sign an affidavit of eligibility and a release (including a publicity release) as prepared by the Station, as well as a waiver prepared by Upper Limit Aviation.  In exchange for the right to participate in the Contest, each contestant agrees to release and indemnify each of the Sponsors, (Bonneville International Corporation, Maverik Country Stores, Salt Lake Community College, Upper Limit Aviation, and Cornerstone Aviation) and the officers, directors, agents, parent companies, subsidiaries and employees of each of the Sponsors, for, from and against any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that arise out of the contestant’s participation in the Contest. 

Publicity Release: Entry into the Contest constitutes permission for each Sponsor and its designees to use the contestant’s name, likeness, portrait, voice and/or biographical material for an unlimited period of time in order to advertise, promote or publicize the Sponsor and/or the products and services of any of its designees.   

Other Conditions: Anyone using fraudulent means to participate in and/or win the Contest will be subject to disqualification.  The Sponsors are not responsible for technical, hardware, software or telephone or other transmission failures of any kind, lost or unavailable network connections or incomplete, garbled or delayed computer transmissions, or any late or lost entries, regardless of cause.  The Station reserves the right in its sole discretion to cancel or suspend the Contest should a virus, bug or other problem beyond the control of the Station corrupt the administration, security or proper execution of the Contest.  EACH PRIZE WINNER USES THEIR PRIZE AT HIS/HER OWN RISK.  NOTHING HEREIN SHALL BE CONSTRUED AS REQURING A PRIZE WINNER TO USE ANY COMPONENT OF HIS/HER PRIZE; SUCH DECISIONS SHALL BE AT THE SOLE DISCRETION, AND AT THE SOLE RISK, OF THE PRIZE WINNER.

    6.    Rules.  Copies of these rules are free and available at the Site, at the studios of the Station, Broadcast House, 55 North 300 West, P.O. Box 1160, Salt Lake City, Utah 84110-1160, during regular business hours or by sending a request, along with a self-addressed stamped envelope, to the Station at this address.
