Charges: West Valley man facing deportation kidnapped, raped ex-girlfriend after jail release

WEST VALLEY CITY — A criminal case filed Friday alleges a West Valley man kidnapped and raped his ex-girlfriend one week after being released from jail and ordered to leave the country.

Eladio Gonzalez, 39, is charged in 3rd District Court with aggravated kidnapping, rape and forcible sodomy, all first-degree felonies, as well as forcible sexual abuse and obstructing justice, both second-degree felonies.

Gonzalez allegedly forced his ex-girlfriend into his vehicle after she returned home from a date on Sept. 24. He then drove to an area near 7000 S. Redwood Road, parked and forced himself on the woman even though she "pleaded with Gonzalez to take her home," according to the charges.

Charging documents say Gonzalez raped the woman and performed multiple other sex acts on her against her will.

The woman eventually was able to answer a call from a family member on her cellphone, and officers traced the call to determine her location, court documents say. Officers were already investigating what had happened to the woman because of a phone call she made when Gonzalez took her, charges state.

Gonzalez previously had been "ordered that if (Immigration Customs and Enforcement) did not deport him, (he) was to voluntarily exit the United States within 24 hours," according to court documents.

"Although Gonzalez had an immigration detainer, ICE did not deport him," the documents say. "Gonzales was released from jail and committed (the alleged kidnapping and rape) approximately seven days later."

He is currently being held in the Salt Lake County Jail.

Gonzalez was charged in December with two counts each of forcible sodomy and rape, as well as violation of a protective order. Each of those charges was dismissed on July 11.

He pleaded no contest to kidnapping, a second-degree felony, on the same day but as part of a different case. Gonzalez pleaded guilty to violation of a protective order, a third-degree felony, in a third case that was also resolved on July 11.

He was technically sentenced to 200 days in jail at the time but was given credit for 199 days already served behind bars.

Gonzalez's criminal history in Utah also includes convictions for assault, theft and contempt of court. Since 2013, three protective orders have been filed against him.
