SALT LAKE CITY — A judge is delaying a decision on whether a Kearns woman is mentally fit to stand trial in the case of a newborn baby left in a trash can.
Judge Elizabeth Hruby-Mills said Monday she is waiting for a second evaluation of 23-year-old Alicia Englert, who is facing an attempted murder charge. The judge rescheduled the hearing for Feb. 9.
Court documents say Englert gave birth in a bathroom at home in August and abandoned the infant in a trash can. Prosecutors say the baby girl would have died if she wasn't found by a neighbor.
The child recovered and is being adopted. Englert's family has said she has a learning disability and didn't understand the situation.
Englert has not yet entered a plea. Defense attorneys declined to comment Monday.
