MILLCREEK — A mother and son have been charged in a drive-by shooting that police say followed a fight at a Millcreek high school last week.
Investigators say Damian Garcia, 17, fired several shots out of a car window in the direction of people he had been fighting with as his mother, Lisa Egersdorf, 36, drove and asked, "Did you get them?" according to charges filed in 3rd District Court on Tuesday.
Egersdorf, who was arrested the following day, told police she and her son are members of the same gang.
Garcia reportedly got in a fight Sept. 22 with three men inside Granite Connection High School, near 3900 South and 500 East, before administrators broke up the altercation, a juvenile female told police. The girl reportedly tried to stop the fight, then left the school with Garcia.
The girl and two other juveniles got into the back seat of Egersdorf's car while Garcia got into the front.
Garcia reportedly told his mother, "Mom, they just jumped me," the girl told police.
"It's all right. We're going to go get them," Egersdorf replied, according to the charges.
As the car passed a 7-Eleven where the three males from the fight — two adults and a juvenile — had run to, the girl told police she put her head down and heard gunshots as Egersdorf asked if Garcia had hit group. Another juvenile in the car told police he saw Garcia lean out the car window and pull the trigger.
The victims' vehicle, a Chevy Tahoe, was struck several times, but no one was injured. A second vehicle in the parking lot was hit once while the driver was in the store, charges state.
Garcia was charged Tuesday with six counts of discharging a firearm and three counts of aggravated assault, all second-degree felonies, as well as one count of reckless endangerment, a third-degree felony. A warrant was issued for his arrest.
Garcia, a teenager, was charged as an adult because he is over 16 years old, is accused of a crime considered a felony if it is committed by an adult, and has previously been committed to a secure facility, court documents state.
Egersdorf was charged in 3rd District Court on Friday with six counts of discharging a firearm and three counts of aggravated assault, all second-degree felonies; one count of obstructing justice, a third-degree felony; and three counts of reckless endangerment, all class A misdemeanors.
A search of court records indicates Egersdorf pleaded guilty in 2013 to reduced charges of criminal mischief and attempted obstruction of justice, both class A misdemeanors, and contributing to the delinquency of a minor, a class B misdemeanor. She was convicted of class B misdemeanor assault in 2012.
