Expert to review autopsy of NYC chokehold victim

NEW YORK (AP) — The expert forensic pathologist who conducted an autopsy of the 18-year-old shot by a police officer in Missouri will be reviewing the final autopsy report of a New York City man who died after being put in a police chokehold, the attorney for the man's family said Thursday.

Attorney Sanford Rubenstein said Dr. Michael Baden is scheduled to look at Eric Garner's autopsy report on Friday. He will also look at all microscopic slides, all organs and tissues that the city medical examiner's office has. The medical examiner's office confirmed the review and said such an action was routine.

Rubenstein said Baden was expected to discuss his findings with the media after the review was concluded.

Garner, of Staten Island, died in July. The 43-year-old father of six came to police attention over alleged sales of loose cigarettes. On the day he died, a cellphone video shows Garner, who was black, having a prohibited chokehold used on him by a white police officer. He was forced to the ground. The asthmatic man was heard saying multiple times that he couldn't breathe, and he died a short time later. The medical examiner's office ruled his death was a homicide.

The case against the police officer has been sent to a grand jury.

Baden is the pathologist who conducted an independent autopsy of Michael Brown, who was killed in an August encounter with a police officer in the Missouri town of Ferguson.
