Utah A.G.'s office announces plans to sue Bank of America

SALT LAKE CITY — Victims of foreclosure are glad top Utah authorities are now on their side. The attorney general's office put Bank of America on notice Thursday they plan to sue if the bank doesn't comply with Utah law.

Michael waters had quite the reaction when he heard the Utah Attorney General's Office is taking on the big bank: "It's about freaking time," he said.

The Pleasant View resident has been fighting Bank of America on his own after he says they foreclosed on his house after a loan modification program. He says the attorney general's office is brave to take on the big bank.

"It's a big battle. They are going to fight them tooth and nail," waters said. "They've been fighting me tooth and nail."

Utah's chief deputy attorney general, John Swallow, says hundreds if not thousands of Utahns have no recourse.

"In Utah, we do a non-judicial foreclosure process so it has other safeguards for consumers," Swallow said. "That's one of the safeguards, that they have someone to contact if they have questions or concerns about the foreclosure process."

"(With Bank of America,) they'll call a number and they don't get an answer," Swallow explained. "They try to leave a message and no one will respond to them."

The attorney general's office has given Bank of America 30 days to comply with Utah law or be sued.
