ST. GEORGE, Utah (AP) -- Prosecutors have dropped charges against a St. George couple after they say photos of the father kissing his naked baby son were not abusive in nature.
Four felony counts have been dropped against 34-year-old Sergio Diaz-Palomino. Two felony counts have been dropped against his girlfriend and the child's mother, 22-year-old Alma Vasquez.
A Walgreens drug store technician reported allegedly questionable images of the child on film brought in by Diaz-Palomino.
Court records say the photos show Diaz-Palomino posing with the boy and kissing his head, forehead, ear, buttocks and genitals. Vasquez had allegedly taken the photos.
Deputy Washington County Attorney Ryan Shaum says the images are consistent with family photos of a proud father with his son.
However, Diaz-Palomino and Vasquez are allegedly undocumented immigrants and may be deported.
