Former UHP trooper arrested on 2nd DUI

WASHINGTON COUNTY -- A former Utah Highway Patrol lieutenant, who lost his job following a DUI related crash in 2006, is in legal hot water again.

The Highway Patrol confirms Fred Swain was arrested on Monday in Washington County on another DUI charge. This time, troopers say, he was driving a semi truck.

Sgt. Jeff Nigbur says an agent working at the Port of Entry in Washington County called them after noticing Swain acting oddly. The agent also thought he smelled alcohol on the driver's breath.

"It's my understanding he was not extremely cooperative with us," Nigbur says. In fact, he refused to take a breath alcohol content test. Swain was booked into jail on a DUI charge.

Nigbur said Swain's truck was the subject of an "attempt to locate" while it was traveling through Arizona. He said someone called to say he was driving erratically.

At one time, Swain was the commander of the Utah Highway Patrol's DUI squad. But in June of 2006 he was charged with DUI following a crash on the Bangerter Highway. He eventually pleaded guilty to a lesser charge and was sentenced to probation and a fine.

Swain's police officer certificate was suspended for four years.
