NORTH OGDEN, Utah (AP) — A group of North Ogden residents has filed a lawsuit against the city, seeking to stop construction on an amphitheater and restore a city park back to its prior condition.
The Standard-Examiner reports the residents are seeking a preliminary injunction on the multimillion-dollar project in Barker Park until the parties can sort through the issue.
The residents claim the project violates covenants in a warranty deed and will cause disruptions.
In a response filing Wednesday, city attorney Jon Call says halting construction would cause substantial loss of money and the city would be liable for contractors' lost profits and other fees.
Plans have been the works to upgrade the small, uncovered amphitheater since at least 2015. The city signed off on the project last year and construction started in November.
