SPANISH FORK — A Spanish Fork woman conspired last month to have her ex-husband murdered, charges filed Wednesday allege.

Billie Jo Agee, 46, is charged in 4th District Court with criminal solicitation to commit murder, a first-degree felony.

Between Feb. 13 and Feb. 20, Agee "solicited her second estranged husband to kill her first ex-husband so she could get access to her children and obtain the proceeds of his $1 million life insurance policy," court documents say.

Spanish Fork Police Lt. Matt Johnson said a specific strategy was not discussed as part of the alleged plot.

"She did not state how she wanted it to happen, she just made requests ... two to three times," Johnson said.

No money changed hands, but Agee made it clear "that she wanted the ex-husband out of the way," the lieutenant said.

The estranged husband who Agee solicited for help does not live with her, Johnson added

Agee's criminal history in Utah includes a guilty plea to DUI in May 2016, according to court records. A child support lien case was filed against her on March 8 by the Utah Office of Recovery Services, records show.
