Campus police finish USU-Eastern sexual assault investigation

PRICE — Utah State University-Eastern campus police have finished their investigation into allegations of a sexual assault that allegedly took place in one of the school's residence halls.

Investigators turned over a 64-page police report and all of the evidence collected to the Carbon County Attorney's Office on Thursday, nearly a month after it was first reported.

The county attorney's office will decide whether to file criminal charges against four people, including two men and one woman who are members of USU-Eastern's basketball teams.

College administrators released the police report, which details dozens of interviews with students and staff, as well as physical evidence collected and examined.

"At this time, the police report has been sent to the Carbon County attorney and it is in their hands," USU-Eastern Vice Chancellor Greg Dart said in an email to the Deseret News. "If any criminal charges come from the report, it will come from them."

Dart said the school is still conducting a Title IX investigation to determine whether the student code of conduct was violated and whether student sanctions are necessary.

"As of now, the only sanctions are the previously reported athletic suspensions," Dart said. "The information will be reviewed as it is available, and other sanctions could be brought."

Report details

The report details the allegations in conflicting accounts between nearly a dozen students — including those considered suspects in the case. The report names three male suspects, two of whom are basketball players, and a female, who is also a basketball player. All three athletes were suspended from team-related activities until the situation is resolved, either criminally or by the school.

According to the report, the sexual assault was reported by a student who witnessed some of the attack but was not involved, confirming what the victim told the Deseret News three weeks ago.

The victim told the Deseret News she had no memory of being assaulted, but she woke up with visible injuries, including cuts and bruises. She was told about the reported sexual assault by a school counselor, who persuaded her to go to Castle View Hospital that same day.

All of the suspects said the victim was intoxicated, and one reported hearing her tell one of the alleged attackers "no" repeatedly when he tried to engage in a sex act with her, the report said.

The victim said she believes she was drugged because she drank from a cup offered to her by a female friend and then shortly afterward has no memory of anything that happened.

The police report said the suspects may have taken pictures or video of the incident, and one suspect allegedly posted pictures on social media of the victim laying in vomit on the floor of a dorm room.
