Man in Ogden restaurant shooting charged with attempted homicide

OGDEN — A man shot by police inside a popular Ogden restaurant in November is out of the hospital and in the Weber County Jail facing charges of attempted homicide.

Leonard Russell Marion, 36, of Ogden, was charged Tuesday in 2nd District Court with attempted aggravated murder, a first-degree felony; drug distribution, a first-degree felony; possession of a dangerous weapon by a restricted person, a second-degree felony; and interfering with an arresting officer, a class B misdemeanor.

Ogden police had released few details about what happened the night of the shooting. New court documents, however, allege Marion pulled out a gun and fired at police first before an officer returned fire.

On the night of Nov. 20, officers from the Weber Morgan Narcotics Strike Force went into Lee's Mongolian BBQ, 2866 Washington Blvd., looking for Marion "to arrest him for an incident on Nov. 17 where he fled from police," according to charging documents.

"As Leonard was leaving Lee's Mongolian, agents informed him that he was under arrest and attempted to take him into custody. Leonard fought with the officers. Leonard pulled a .45-caliber handgun from his waistband and fired one shot at the officers. An officer returned fire, and Leonard was struck three times," the report stated.

One officer reportedly suffered minor injuries during the struggle.

After the shooting, police found about 20 grams of meth in Marion's pocket, according to the charges.

Marion has a long history of drug-related crimes, according to Utah court records. He was charged in March with selling drugs from a hotel room where police also found two small children.

He was convicted of drug distribution in 2011 and was sentenced to up to five years in prison, court records state. In a second case the same year, he was sentenced to one to 15 years in prison. Marion was also convicted of felony drug possession in 2008 and 2005 and sentenced to up to five years in prison each time.

Marion was being held Friday in the Weber County Jail without bail. In his mug shot, he is still wearing a hospital gown. His next court hearing is scheduled for Monday.
