NORTH SALT LAKE — An officer arrested a man in possession of methamphetamine after the man was “nervously eyeing him” in a convenience store, the sheriff's office said.

The incident occurred Monday around 9:45 a.m. at the Maverik gas station at 200 N. 745 West, according to Davis County Sgt. DeeAnn Servey. An officer was inside the convenience store when he saw a man buying a root beer and “acting suspicious,” Servey said.

“(The man) was just overly acting strange, like trying to avoid eye contact and acting just nervous — more nervous behavior than the average person,” Servey said.

The officer returned to his patrol car and ran the license plate for the man’s vehicle. The officer discovered the man had a revoked driver’s license and several alcohol restrictions, Servey said.

When the man exited the convenience store and got into his vehicle, the officer initiated a traffic stop and asked about the man’s driver’s license. The man was only able to produce a U.S. passport and the officer detained him for the driver’s license violations, Servey said.

The officer searched the man and located $1,000 in bills in the man’s pockets, Servey said. There were also around 30 empty bags in the back seat of the vehicle and drug paraphernalia.

The officer also saw a small bag floating inside the bottle of root beer sitting on the passenger seat and when he took out the bag, the crystals inside tested positive for methamphetamines, Servey said.

Daniel Avelar was arrested and booked into the Davis County Jail on suspicion of possession of a controlled substance, ignition interlock violation, possession of drug paraphernalia and obstruction of justice.
