SALT LAKE CITY (AP) — A Utah appeals court has upheld a decision sentencing a 42-year-old man paralyzed in a neighborhood watch shooting to 10 years in prison for having sex with a 17-year-old neighbor girl.
Attorneys for David Serbeck argued in April that his original lawyers should have pushed harder to exclude or dispute allegations tying the 2007 relationship with the teen to his shooting.
Serbeck was shot and paralyzed in July 2009 by Reginald Campos, who suspected Serbeck of aggressively following his teen daughter while patrolling the Bluffdale neighborhood.
The assistant attorney general argued that it was Serbeck's unapologetic attitude and unwillingness to accept responsibility the earned him two consecutive five-year sentences.
The Utah Court of Appeals decided Thursday to uphold the 2012 conviction and sentence.
Serbeck is three years into his sentence.
