SAN DIEGO (AP) — San Diego County has agreed to pay $1 million to settle a lawsuit by a man with Down syndrome who said he was beaten and pepper-sprayed by a sheriff's deputy in 2012.
The San Diego Union-Tribune (http://bit.ly/1ICMVUY ) cites an email from Antonio Martinez's lawyers that says the payment was agreed to by the Board of Supervisors.
Attempts to reach county representatives Friday, a government holiday, were unsuccessful.
The lawsuit filed last year alleged that Deputy Jeffrey Guy beat Martinez with a metal baton, sprayed him with pepper spray, then handcuffed him and held him for five hours without letting his father see him.
Guy was investigating a domestic violence report at the time and said he considered Martinez to be acting suspiciously.
Martinez was cited for obstruction of justice, but the charge was dropped.
