These charging documents reveal that Carlos Prieto's blood alcohol level was over the legal limit. That's based on a preliminary test so prosecutors won't say exactly what that was. Prosecutors have charged Prieto with three counts of automobile homicide, three counts of driving under the influence and driving without a license.

Charging documents say Prieto had a strong odor of alcohol on his breath and slurred speech. He voluntarily admitted to officers that he had just had five beers.

Yesterday, immigration officials told us they believe Prieto is in the country illegally from Mexico, and have placed a hold on him. That means Prieto will be turned over to the Immigration and Customs Enforcement once the criminal case against him has been taken care of.
