LAYTON — A man suspected of committing a Layton robbery was cleared of the crime after a man matching his description robbed the same convenience store while the first man was in jail.

On Tuesday, the Sinclair station at 1508 N. U.S. 89 was robbed. By Tuesday night, police arrested Daniel Goodell, 33, and booked into the Davis County Jail for investigation of aggravated robbery in the crime.

Goodell was a former employee at the Sinclair who stopped working there about a week ago. Goodell, who has a history with Layton police, admitted to investigators that he had talked about robbing the store but did not admit to actually committing the crime, said Layton Police Lt. Shawn Horton.

But the store clerk who was working at the time of the robbery allegedly picked him out of a photo lineup.

"There's a very small portion of his face that the clerk actually saw," Horton said. "This guy was a former employee there, but the particular clerk had never worked with him before."

Store surveillance video from the robbery showed a man in a hoodie who was about the same height as Goodell, but his face could not be seen on camera, Horton said.

But just hours after Goodell was booked into jail, the same Sinclair station was robbed again by a man with similar features and mannerisms as Goodell. The robber wore a hoodie and a baseball cap underneath.

This time, the clerk initially refused to give him money and got into a struggle with robber. During the confrontation, the man's hoodie and ball cap came off, giving surveillance cameras a good shot of his face.

After that video was released to the media, detectives received a tip about a possible suspect. They interviewed Tyler Hart, 36, of Clinton. Hart admitted to robbing the Sinclair station both Tuesday and Wednesday, according to Horton.

He also admitted to three robberies in Bountiful since May, including a Tesoro station at 2600 S. U.S. 89 just hours before the Sinclair robbery on Tuesday morning as well as on the morning of Oct. 3, Horton said.

Hart told investigators he would stick his fingers in his sweatshirt pocket to simulate a gun, the lieutenant said.

Hart was booked into the Davis County Jail for investigation of five counts of aggravated robbery. The robbery case against Goodell was subsequently dropped. But he remained in the Davis County Jail Friday on a probation violation.
