SALT LAKE CITY (AP) -- A federal judge has declined to revive a wrongful death lawsuit filed by the widow of Richard Ricci, a one-time suspect in the June 2002 kidnapping of Elizabeth Smart.
Angela Ricci filed lawsuits against Salt Lake City and the state of Utah after the death of her husband.
A parolee at the time of the kidnapping, Ricci, 48, had worked as a handyman at the Smart's Salt Lake City home. During the investigation, he was returned to prison on a parole violation. He suffered a brain hemorrhage in his cell and died Aug. 20, 2002.
Angela Ricci lost in the state courts on an appeal. In November, she asked the federal court to revive the case, citing attorney misconduct.
On Wednesday, U.S. District Judge Ted Stewart said Ricci waited too long to make the request.
