SALT LAKE CITY (AP) - A death row inmate's conviction and sentence will stand after the Utah Supreme Court upheld a lower court's ruling to dismiss his appeal.
Douglas Carter was convicted in 1985 of the first-degree murder of Eva Olesen, 57, during a robbery at her Provo home. Olesen was stabbed 10 times and shot in the head.
Carter appealed to the Utah Supreme Court a ruling by Fourth District Court Judge Lynn W. Davis, who dismissed his petition for post-conviction relief. Carter had claimed that he received ineffective legal assistance after his initial conviction, but Davis ruled his claims were without merit.
The state Supreme Court agreed in a ruling Friday.
