SPOKANE, Wash. — A woman accused of unlawfully removing her child from the state of Utah was arrested Saturday in Spokane, Wash.

Lady Ashley Marks, 21, was arrested without incident by members of the U.S. Marshals Service Pacific Northwest Violent Offender Task Force with assistance from the Spokane Police Department and the Spokane County Sheriff's Office. At the time the alleged offense occurred, the child was the subject of a custody dispute between Marks and the estranged father of the child.

Pending further court proceedings, the father of the child had been granted temporary custody. However, on Oct. 15, Marks was allowed to visit the child under the supervision of a paternal grandparent. Sometime during this visit, the grandparent was momentarily distracted, and Marks left the residence with the child.

After an investigation by the Murray Police Department, it was determined that Marks had fled the state with the child in violation of existing court orders. Based on the investigation, the District Court issued a warrant charging Marks with Custodial Interference Across State Lines, which is a third degree felony offense. Bail was set at $250,000.

A multi-agency collaborative effort was the key to the arrest of Marks and the recovery of the child. This arrest illustrates that state lines do not offer protection to those who attempt to flee from justice.

A subsequent investigation determined that Marks and the child were residing in the Spokane area. Authorities in the area initiated surveillance on a residence in Spokane, and Marks was ultimately located.

Marks has been booked in to the Spokane County Sheriff's Office Detention Services holding facility pending extradition back to Utah.

"A multi-agency collaborative effort was the key to the arrest of Marks and the recovery of the child," said James A. Thompson, U.S. Marshal for the District of Utah. "This arrest illustrates that state lines do not offer protection to those who attempt to flee from justice. We hope that all of the involved parties in this case can move forward in determining the best interests of the child."
